Florida Law Says These States’ Driver Licenses Are No Longer Valid

When laws are drafted by state legislatures, voted into law and signed by state governors, there are consequences. Some of them are, of course, in line with the intention of the new law. But some of the repercussions are not necessarily the intent of the legislation. Of course, those who wrote the law may or may not be concerned about how people react to their new restrictions on the state, but that’s rarely here nor there (except maybe during an election year).

The State of Florida, under Gov. Ron DeSantis and a supermajority in both houses of the state legislature, has voted several new laws over the last legislative session, some of which took effect as of July 1st.

Many of the new laws are controversial and are under judicial contest. However, one of them that took effect was SB 1718, which was promoted as a fix to illegal immigration in Florida.

I’m not going to get into the details of the new law and how it will affect Florida residents, industries and every other aspect of society. However, I do want to point out how it may inadvertently affect people who want to travel to the State of Florida.

After the law went into place, the Florida Department of Highway Safety and Motor Vehicles published a list of out-of-state license classes that are invalid in Florida.

They include:

  • Connecticut licenses that indicate “Not For Federal Identification”
  • Delaware licenses that indicate “Driving Privilege Only” or “Not Valid for Identification”
  • Hawaii licenses that indicate “Limited Purpose Driver’s License” or “Limited Purpose Instruction Permit” or “Limited Purpose Provisional Driver’s License” or “Not Valid for use for official Federal purposes”
  • Vermont licenses that indicate “Not for REAL ID Purposes Driver’s Privilege Card” or “Not for REAL ID Purposes Junior Driver’s Privilege Card” or “Not for REAL ID Purposes Learner’s Privilege Card”

If you have any of these licenses and are pulled over by the police in Florida, you will be cited for driving without a valid driver’s license.

While the licenses from Connecticut, Delaware and Vermont are specifically only issued to undocumented immigrants, Hawaii’s Limited Purpose licenses are issued if you move to Hawaii and transfer your out-of-state driver’s license to your new home. This means some U.S. citizens have one of these “verboten” licenses.

The Florida Department of Highway Safety and Motor Vehicles even appears to be having problems interpreting the law, as some licenses from Rhode Island were originally included on the list, but have since been removed.

Florida will undoubtedly have to defend this law in court if they choose to issue citations to people who have these types of licenses.

But this leads to another question: if you can fly to Florida with one of these drivers licenses in your possession, will a company rent a car to you if Florida deems your driver’s license to be invalid? If so, what happens if you get a speeding ticket? Will you be arrested for driving without a license?

SB 1718 opens up many questions for people visiting Florida. While the law was intended to combat illegal immigration, the law is so vague that it could prevent people – even some U.S. citizens – from visiting the state. It’s impossible to know if this was intended or not.

everything about the illegals is illegal, including their drivers licenses

They forgot Washington state. Undocumented aliens (aliens is the term on some signs) are allowed to get regular driver’s licenses which is why WA state licenses are not RealID compliant. Washington got around the law because they do offer a more expensive RealID that few US citizens buy.

If this keeps going, soon many states will offer airline type “enhancements”, such as out of state licenses needing to buy a special sticker to be valid in another state.

Very strange. This article covers what news sources are saying but when I read the actual law, I see no such restriction. The YMMV link is to this website… https://www.flhsmv.gov/driver-licenses-id-cards/visiting-florida-faqs/ That link cites the Florida statute and a link, which is here… http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0322/Sections/0322.03.html There is no restrictions on out of state licenses.

This article does have a link to SB1718 but I suspect it has not been codified yet. Even when it does, SB1718 says ” specifying that certain
9 driver licenses and permits issued by other states
10 exclusively to unauthorized immigrants are not valid
11 in this state

Hawaii’s license is not exclusive to unauthorized immigrants but US citizens can have it, too. In real life, nearly all US citizen will choose the RealID because the price is the same.

The Florida website is WRONG but I am too busy to follow up on a complaint.

CT and DE appear to meet the threshold to be banned but HI and VT are WRONGLY listed as being banned. Not true, US citizens can get those banned categories of HI and VT licenses so they are permitted (wrongly banned). Only CT and DE special licenses are available only to undocumented aliens.

Nice to see the Florida state legislature spending time and effort on really important issues like this rather than crime, traffic, climate change, increasingly unaffordable housing, and drawing businesses that offer well paying jobs. Sigh.

So Christian, you must really be angry at the Biden administration and the states of California and NY focusing all their efforts on trans rights (what .01% of the population) and laws that benefit criminals and encourage illegal activity instead of dealing with crime and affordably priced housing. You think it’s up to state government to address climate change and not the federal government and corporations? What blue states/cities have done a bang up job of addressing crime or bringing in jobs. The bluest cities are losing jobs, people and businesses like crazy while crime is through the roof – SFO being a poster child of this. On the other hand, FL has seen a significant influx of wealth and new jobs. If you really think FL is a poorly run state, give us your take on CA? Such grasping at straws when the socialist try to criticize FL when their own houses are in utter shambles.

Also, this is an important issue because it doesn’t encourage illegals. I’m not saying immigrants, I’m saying illegal ones although everyone from a blue state seems to think there is no difference I guess since they are hoping the illegals will vote for them.

@Christian: Actually, this is related to all of those “important” issues, aside from “climate change” which is something that no law will fix anyway. The banned licenses/IDs are items that are not recognized because they are the equivalent of you (as an American) getting a drivers license in Honduras and then trying to use it as a vehicle to vote/get free medical care/etc down there.

Of course, other countries aren’t so stupid as to EVER allow this. Nor is Florida. Kudos to them for not being idiots like Vermont.

@chistian Preventing criminals from driving in Florida is certainly permissible and a good use of time and effort by the Florida legislature. Either we have laws and enforce them or we live in chaos.

Check with San Francisco to see how the chaos thing is working out.

Need to add NY,NY,CALIF as they all give drivers licenses and other benefits to illegals!!
